Harry Smith's Anthology booklet calls this a "well known popular song".

According to the Where Dead Voices Gather blog, "'Home Sweet Home' was written in 1823 by Sir Henry Bishop and John Howard Payne, adapted from Payne's opera Clari, Maid of Milan." The lyrics of the original composition were in English.

Thus, the basic tune is public domain, but the copyright status of the (Cajun French) lyrics is unknown.
