No image of record label available. Harry Smith's Anthology booklet assigns authorship to "Gates", while victor.library.ucsb.edu credits "Rev J M Gates". However, www.78discography.com does not assign authorship.
According to wikipedia, Gates died in 1945, which means that this composition is in copyright until 1st January 2016.
